SAHRC uncovers widespread racial bias in Hartbeespoort Dam land allocation

The South African Human Rights Commission (SAHRC) has released a damning report exposing systemic racial and gender discrimination in the allocation of state-owned shoreline land around Hartbeespoort Dam.

The investigation found that the Department of Water and Sanitation (DWS) largely excluded Black applicants since 2012; only one Black application was approved out of 78, while white-owned entities often occupied land without valid permits.

Black residents were often evicted without notice, and women faced discrimination.

The SAHRC also blamed the Madibeng Local Municipality for administrative failures that worsened racial tensions, including licence backlogs and lax by-law enforcement.

The Commission has ordered the DWS to implement a transformation plan, audit all occupiers, and review revoked permits.

The Municipality must clear backlogs and enforce regulations.

The SAHRC warned that failure to comply will result in legal action.
