  • The EFF is protesting and accusing the Constitutional Court (ConCourt) of deliberately delaying the judgement on their application challenging Parliament’s vote on the Phala Phala report.
  • The application argues that Parliament’s rejection of the report, which contains damning ethical findings against President Ramaphosa, was unconstitutional and violates its mandate to hold the executive accountable.
  • The EFF has said that the twelve-month delay in releasing the judgment is due to incompetence or deliberate political intervention aimed at shielding the President.

The Economic Freedom Fighters (EFF) have staged a protest demanding the immediate release of the Constitutional Court’s (ConCourt) judgement on the Phala Phala matter, accusing the court of protecting President Cyril Ramaphosa.

The EFF launched its application in 2024, challenging Parliament’s decision to reject the Section 89 panel report.

This 2023 report contained serious ethical findings against Ramaphosa concerning the break-in at his game farm.

The party argued that Parliament’s rejection of the report which shielded Ramaphosa from impeachment proceedings was unconstitutional, as it violated the mandate to hold the executive accountable.

“The failure by the Constitutional Court to provide this judgement and provide certainty on whether the decision by Parliament to refuse to hold the Executive accountable was lawful or not, gives the impression that the President of the Republic of South Africa is above the law,” said the EFF in a statement.

The EFF is demanding an immediate explanation for the unprecedented delay.
