Drive 959 weighs in on how to fight a wrongful traffic fine

The Organisation Undoing Tax Abuse (OUTA) has weighed in on the issue of drivers dealing with wrongful road law violations.

While acknowledging that some drivers illegally flout the country’s road traffic laws, OUTA also noted the frustration of law-abiding motorists who encounter corrupt officials attempting to extort payments for false violations.

Kaya 959 listeners shared their stories on the process to take when you have a dispute.

Speaking to Drive 959, OUTA’s Wayne Duvenage strongly urged drivers to stay calm and polite and to accept any tickets issued, even if they believe them to be invalid.

Duvenage highlighted that the Administrative Adjudication of Road Traffic Offences Act grants motorists the right to dispute a ticket later. He advised that drivers who wish to voice a concern at the roadside should keep it amicable and non-obstructive.

Motorists can later make representations against the fine or elect to be tried in court. Importantly, these representations can be lodged outside the province where the fine was originally issued.
